Legal Question in Civil Litigation in California
My roommate and I have been living together two months. She is an alcoholic and recently attacked me during one of her drunken nights. No charges were pressed at the time of the incident because I had defended myself but the police were not there to witness, so they suggested I not press charges because she would likely also press charges against me, and we would have both gone to jail. I filed a temporary restraining order against her, and have not been staying at the apartment since the incident. My roommate and I also work together at a local restaurant. The property management wants us out of the apartment complex, and is willing to release me from the lease which still has four months to go. My roommate refuses to let me into the apartment to get my things unless she is there, which makes me extremely uncomfortable. What are my rights and obligations to get my things out of the apartment as soon as possible? What are my rights and obligations in the workplace?

I have dealt with a similar situation. Give my office a call. I can call her and let her know that you will be getting your things. If necessary, I can arrange for a "civil standby" - police escort while you get your things. Do it through an attorney and you have a fair chance of avoiding problems.
