Legal Question in Civil Litigation in California

The roots from a neighbor's tree have raised and cracked the concrete sidewalk next to my garage, and is beginning to crack the garage foundation. What is my legal position to require my neighbor to cut the roots at the property line? Thank you

You have no right to require the neighbor to cut the roots at the property line. However, you have the right to do it yourself if it does not kill the tree or destablize it such that it will fall.
