Legal Question in Civil Litigation in California

While seperated from my wife she embezzeled and commited forgery against her employer and used his company checks to pay the mortgage on a rental property we have, keeping the renters money as well as money I gave her for this mortgage payment. I now own this house, can the ex employer come after me for restitution or after the home in question?

The employer could sue you, but I doubt they would recover unless you ignored the case and defaulted. The employer can't take your home without getting a judgment first and then having an execution sale on the house.

I'm not aware of any viable legal theory that would make you liable simply because the stolen funds paid your mortgage, unless you conciously participated in the embezzlement and any money laundering. The employer obviously has both civil and criminal remedies against your wife.
