Legal Question in Civil Litigation in California

serving small claims papers

Facts:

I have had someone make several attempts to serve the defendent. No one has been home. I do not have a business address.

I do not have the financial means to pay the sheriff to serve the defendent.

Question:

How do I proceed without jeopardizing my case?

You'll have to try serving at night or stake out the house.

Problem serving Defendant

Unless the defendant is served with the summons, you have no case.

Try being creative. Stake out the house, play like a pizza delivery person, try in the morning, or in the evening.
