Legal Question in Civil Litigation in California
Settlement Agreement
If a Settlement Agreement was entered into court record about a year ago and nobody ever submitted an order to dismiss and the case is still open, and the defendants fail to abide by that agreement, what are my options?

Attorney At Law
You could file a motion asking the court to dismiss the case and also ask the court to order the plaintiff to pay your attorney fees for the cost of the motion.

Enforcing a Settlement
If I read your message correctly, you are the plaintiff and they have not made the payments called for under the settlement agreement. If that is the case you can move the court to enforce the settlement.
