Legal Question in Civil Litigation in California

settlement in an auto accident

I was involved in an auto accident. The other party's insurance company had billed me for reimbersement. My insurance will not make that payment because I missed my payment. I still don't know who's at fault in this accident. The questions are: should I pay the other party? By making the payment will DMV assume it was my fault? How will I be guaranteed that there won't be anymore claims?

Re: settlement in an auto accident

Paying a claim, without at least a disclaimer of any liability, is an admission. It is impossible to determine from your question, whether the accident was you fault. You will have to disclose more of the facts for anyone to give you an opinion as to fault. You should also include what damages, that is injuries, you sustained, if any.
