Legal Question in Civil Litigation in California

slander

I was acussed of Sexual harrassing a female employee by another woman. In thedays that followed this acussation I explained my self and was cleared,but I have been treated like I have done some thing wrong but the woman who acuused me has been told that she did the right thing. My boss has told me to just drop it and go on. but the hole thing That bothers me is that my reputation and credabilty has been questioned and being that I am totally inocent of these charges I still have to explain myself to the upper management. I am being treated like I am guilty as charged and have been warned to not make it an issue. I feel that my job and livly hood could be in jepardy if I don't comply. Is there any thing I could do?

You're probably out of luck on this point. You can only prevail on a slander action if you can prove (among other things) that, at the time of the accusation, your accuser either had actual knowledge that her accusation was false or that she made the accusation with reckless disregard for the truth. If the jury determines that she genuinely believed you had done these things, then you will lose.

You will also have to overcome an additional problem in that the jury will not want to cause other witnesses in the future to fear being sued if they make an honest report of such harassment. Thus, the jury will be less willing to hold in your favor than otherwise might be the case.

Unless you have some good evidence that your accuser was not acting in good faith, the courts may not be the best way for you to clear your name.
