Legal Question in Civil Litigation in California

Is a slander case reasonable or provable?

A sub-contractor in his attempt to collect on work he did not complete resorted to harrasing our customer and Vender account saying many false statements which has cost our company alot of time and money. What do we need to prove to have a case against this SOB.

Re: Is a slander case reasonable or provable?

Slander is a difficult area of law. The Court requires that the plaintiff prove that the defendant in question willfully and intentionally misrepresented facts in order to harass and defame. Basically, you would need witnesses to testify in Court that this guy said statements that defamed you and that he said it with the knowledge that it was false with the intent of harassing you. You may want to have a lawyer send this guy a cease and desist letter stating that a lawsuit will be filed against him if he does not stop defaming and harassing. A threatening letter usually works. If not, you may want to file a lawsuit against him. If you would like to discuss this matter further please feel free to contact my office by email at [email protected]. I wish you the best of luck if I don't hear from you.

Sincerely,
