The maximum amount you can sue for in small claims is $5,000.00.

You can sue for an amount greater than $5,000 in small claims court. However, you will only be able to get a judgment for $5,000. There is a way around that is to get the other party to agree to let the court dedide the case for it's actual value. Some defendants agree to this because of the relaxed nature of small claims. Being faced with a small claims case for more than $5,000 or a complicated case in Superior Court, a defendant may elect to waive the $5,000 limit.
