Legal Question in Civil Litigation in California

Small claims when defendant is out of state

I am thinking of suing an individual for breach of oral contract for $600. The contract was made in California. However, the individual lives in Texas now. Is it possible to sue this person in small claims court even though they live out of state?

Thank you

Re: Small claims when defendant is out of state

you can try but most small claims courts will not accept a filing on an out of state defendant. If you file in municipal court it shouldnt be a problem.
