small claims subpoena

Great job love your site! I am suing the therapist of my ex ( i sued my ex for unauthrized use of my medical benefits and i prevailed , which she implacated her therapist in medical fraud she confess to the judge ) i did a ''small claims subpoena'' on my ex and it is was properly served, she wrote to the court, the heading was '' Request to dismiss and of intent for non-appearance per subpoena order'' i need the Ex for me to win! is this a proper order ? what can i do?I do have the jugdement that i won agaisnt the EX! HELP!

She must appear. If she does not, a bench warrant can and will be issued. However, supoena the file on the suit against your wife. The judge may have written down her statements in the file.
