Legal Question in Civil Litigation in California
My son's father was wrongfully convicted in California and spent 8 years in the penitentiary there. After his release, it was found that he was innocent and the officer planted drugs on him as he has stated all along. California compensated him for his time in the pen and everything. We met sometime after that and had a son. His father has not been normal and has been basically mental since his release. Can I go and sue for assistance for my son because he is barely able to function in society.

I'm afraid not. We all have our wounds, and sometimes those wounds affect the way we behave toward our loved ones. That doesn't give our loved ones the right to sue the people who wounded us -- especially after those people have settled with us and after so many years have passed.
