Legal Question in Civil Litigation in California

I spent an extra 90 days after my release date still incarcerated in a California prison. After contacting the Victim Compensation and Government Claims Board, I was instructed by them to file a claim with small claims court. Do you agree with this idea and if so can you tell me who exactly I should name as the defendant?

You need to file a written claim with the Victim Compensation and Government Claims Board on their official foms, mailed certified mail return receipt requested, and then file your lawsuit within 6 months after your claim is denied or rejected, or within 6 months and 45 days after the date your claim is postmarked. The defendant is the individual who is the director of California Department of Corrections and Rehabilitation.
