Legal Question in Civil Litigation in California

statute of limitations on lawsuits against the tobacco company.

My mother passed away 3 years ago of coronary heart disease and I was wondering what the statute of limitations are on filing a lawsuit against the tobacco company. My mother was only 48 years old. At the time of my mothers death our attorney told us that we had to wait for the probate and another lawsuit to be closed before we could procedein filing a lawsuit against the tobacco company. I would appreciate any information you can give me in regards to this matter.

I am sorry for your loss. Generally, the statute of limitations in CA is one year. However, you may have recourse against the prior lawyer(s) for incorrect advice.
