After all defendants have answered, the discovery phase of the litigation begins. During discovery, the parties are entitled to disclosure of all relevant facts, witnesses and documents from the other parties. Depositions of parties and witnesses may also be taken.

Important procedural issues also arise at this stage of litigation. The court will often send the case to mediation or a non-binding arbitration, and the court will also likely set a trial date.

The parties may also file numerous procedural and substantive motions during this time.

Once the complaint is answered, discovery begins. The parties may provide the other with written interrogatories to be answered, and may request the production of documents. The parties may also schedule the depositions of the other party or witnesses.
