I'm being sue by capital one. I contacted their office and try to arranged an agreement of monthly payments, but they required a down payment which i am not able to afford

If the last payment was more than 4 years ago, they might have a statute of limitation issue. To be in the best bargaining position, you should file an answer to the complaint, and make sure to include affirmative defenses. (Many people who do this on their own forget about defenses other than denying that they owe the money.)
