Legal Question in Civil Litigation in California

I need to sue my father who is currently in jail for molesting my 15 yr old daughter. He's 80 yrs old and owns a million dollar home in San Jose CA. He's supposed to pay $39k in restitution for damages up until today at $100/mo when he gets out of jail in 6 months. But he's 80 and I will never get that $ unless I sue for his estate.

You will definitely need an attorney to represent you. If your daughter is still a minor, you can serve as her guardian at litem, but you cannot file the court case by yourself -- an attorney is required in this case. The fact that there is a criminal conviction should be of help in prosecuting the case. I would contact several attorneys who handle civil litigation cases, get opinions, and see what can be done in terms of contingency fees.
