Legal Question in Civil Litigation in California
I'm being sued by what I think is a mistake. its for over $25k and they think i'm the owner of a vechicle that was in an accident. I sold the car to a persson and it looks like they got into a car accident and for some reason the plantiff think i'm the owner of the car. Sold the car 9 months prior to the accident. Been trying to contact the plantiff's attorney and he does not respond or call back. What should I do? Should i file for a dismissal or is that only done by the plantiff side. Or do I Answer and pay the filing fee? Can I eventually request for my fees to paid back to me since they made the mistake and causing me lots of time and headache.Thank you.

This is similar to a question asked earlier. The best thing to do would be to timely answe and, at the same time, file a cross-complaint against the new owner for indemnity. You might also tender the claim to your own auto insurance carrier to see if it will defend you.
It is unlikely that they think you are the owner of the car if you properly processed the sale with the DMV. So you need to get that cleared up right away as well.
