Legal Question in Civil Litigation in California
I am currently suing a lawyer whom was my employer. She sent me a "Request for Statement of Witnesses and Evidence" MONTHS before our trial, Civil Procedure states that this can only be served within 30-45 days before the trial. I followed an attorney's advice and ignored it. Now she is threatening to file a motion to compel if I do not comply and said she will request court sanctions against me. I have until April 11th. Can she really do that if she isn't properly serving the document?! What do I do? File an objection? If so, is there a certain form I should be using? Thank you!
