Legal Question in Civil Litigation in California

theft of tool box

My 29 year old daughter took a tool box out of my garage. I asked her if she took it. she said yes, I told her I wanted it back, she told me no and hung up on me. She also charged $9000.00 on my credit card which she said she was going to pay but I don't think she will. Thank you.

Re: theft of tool box

Your daughter has been stealing from you, and your options are the same as for anyone else who steals -- you can try to negotiate reimbursement but, failing that, you may have to sue and/or file a police report. These are unpleasant things to do where a family member is involved, but the law doesn't provide special procedures to deal with relatives.

You may have some recourse through the credit card company, assuming your daughter is not authorized to use your card. If you have authorized her to use the card then the issuing bank is not to blame. You should notify the bank that you will no longer authorize her to use the card -- in fact, you should have done so once the charges began to appear.
