Legal Question in Civil Litigation in California

Tickets bought on Craigs List

I live in California and posted a ''wanted'' ad for San Francisco's Criag List for some tickets for a show called Teatro Zinzanni. A man called me saying he had tickets for this show (he lives in oakland CA). We made a verbal agreement of $600 for 4 tickets. Based on the arrival of the $600 which I overnighted to his office, he then sent me a fax with a confirmation number. Later when I showed up to get my tickets the box office told me they were for the Seattle location, not the San Francisco location. I never heard him say they were for Seattle and never even assumed they were not for the San Francisco location. I had to repurchase the tickets for even more of a higher price. It was just a verbal agreement, I never signed anything. Is there anything I can do to get my money back?

Re: Tickets bought on Craigs List

You should make a written demand for a refund (or even for the full amount of the replacement tickets, since that is the actual amount of your loss), explaining what happened. If the seller refuses you can sue him in small claims court in Oakland. Your damages will be the amount you had to pay for the replacement tickets.

That you had no written agreement doesn't matter. Oral contracts are often enforceable, and the one you describe sounds enforceable to me.

Good luck.
