Legal Question in Civil Litigation in California

vacation rental agreement

We rented our vacation home to a

group of younger men for 3 nights a

month ago. Our maintenance crew

found a ''meth'' pipe with residue

that was left behind. Our contract

states: Tenant shall use the property

for legal purposes only and other use,

such as but not limited to, illegal drug

use, abuse of any person, harboring

fugitives, etc. shall cause termination

of this agreement with no refund of

rents or deposits.

We told the renter that they would

not receive their deposit back and he

is threatening to sue. What should

we do?

Re: vacation rental agreement

You didn't terminate the agreement prematurely because of their activity. They paid, and you let them use the property. The agreement then expired. I believe they should be entitled to the return of the deposit. Just add them to a list of people to whom you will never again rent the vacation home.
