Are verbal contracts binding? Money was promised to buy a business and the day the money was suppose to be there it never came and temporary money had to be borrowed. If I didn't go ahead with the closing I would have lost 30k. This person that said she was giving me the money never came through but continually lied to me saying she has the money but never came through with it even though she promised in front of other people. She has sent several emails saying she had the 80k and I have all of them. I believed her and I never would have gone through with the purchase of the business had she not promised me the money both verbaly and in writing. Do I have a case?

What are your damages? Obviously, you got the money from somewhere and have to pay it back. Were the terms more favorable with your former friend? Your damages would be the difference in the interest payments between what you now have to pay compared to what you would have had to pay. You would also have to prove that there was a meeting of the minds in the first place. Credibility plays a large role in whether one is successful in such cases.
