Legal Question in Civil Litigation in California
Video taping and invasion of privacy.
I am involved with a neighbor dispute which started with the juvinile child of my neighbor shooting my house with a BB gun. Damage was caused and resulted in an arrest. Harrassment from this boys family started against us, and police advised us to video tape the harrassment and get a restraining order against them.
We did both, but were served with a counter claim of harrassment and invasion of privacy against us for videotaping the ongoing harassment. We stayed on our property to videotape, and only taped when harrassment was being directed towards us.
Looking up penal code section 632 and cicil code section 1708, I am wondering if they have a valid claim of invasion of privacy against us. I fear that we were misled by our local police to video tape the harassment. Are there any exceptions to the above codes in which our video taping is legal and justified? Or are there other codes that state the taping I did was legal?

Dont worry about it. turn it over to your home owner's insurance. this is covered by it and they will provide you with a free lawyer to defend the counterclaim.
