Legal Question in Civil Litigation in California

Help re. vindictive ex girlfriend

I am being threatened with legal action by the lawyer of my ex-girlfriend, who I broke up with last April. She has been harrassing me ever since. Now her lawyer is seeking return of her ''personal photos.'' I no longer have the photos. I destroyed them shortly after I broke up with her. They were not her property at all, but my personal photographs, taken by me. I am greatly concerned because her attorney represents her for free because she often slept with him in the past. His name even appears on the birth certificate of her grandson as the legal father, even though that is not true. Just more of her twisted legal maneuvering. How do I get this lawyer off my back re. these photos and avoid having to respond in court? So far he has only sent U.S. mail to me. I have not been served, but he is threatening to file some sort of action in court if I do not respond to him by Jan. 7.

you can either ignore it or write back saying you have no property belonging to her.

Write back and tell him the photos no longer exist. If he files some sort of legal action seeking to get the photos and they do not exist, he won't get very far, will he? Lastly, even though you took the photos, there are laws which restrict your use of photographs of others, and it may be that your ex believes that you will use these photos to invade her privacy, embarass her, etc., and such conduct could subject you to legal action.
