Legal Question in Civil Litigation in California

Does one need to wait until Proper Service has been performed before going to an ex-parte hearing? Other than the Notice of Ex Parte is there anything else I need to fill out and give to the other side?

You need to read the California Rules of Court sections on Ex Parte hearings. If you are going to represent yourself, you need to do your own homework. Ex parte papers generally are not served before the hearing, but there are exceptions.

An ex parte appearance involves an application, a memorandum of points and authorities, and a declaration. The declaration must show that you gave proper ex parte notice in accordance with the rules of court. The rules of court also require you to serve the papers that you are filing as soon as possible on the other party.
