Legal Question in Civil Litigation in California

I wanted to know if filing ch 13 bankruptcy can help my from my home foreclosing? I have been working with my lender for a modification for over 16 months of hell.They lose paperwork,give me different answers to the same questions,ask for more paperwork ..etc.I feel its just false hope and a way to prolong the process so they can foreclose on me.Im so frustrated!!! Im still waiting for an answer from the underwriter.My home has been in foreclosure status since Jan 2012.It is now August2012.They assure me that there is no sale date yet.I realize once I get a sale date I have no options left.I have an FHA loan so the are guarenteed their money if they foreclose on me.

You should repost in the category for bankruptcy. This category is for lawyers to respond to people with questions about actual pending litigation.

I can tell you, however, that Chapter 13 is usually the only way to protect yourself, stop the sale for a time period, and get the lender into a plan that involves modification.
