Legal Question in Civil Litigation in California
white suburban problem
We had a motor and transmission trouble so we took our car to two different shops to have both rebuilt. The motor shop rebuilt our engine and put the crank shaft of another suburban on there so it caused the engine and the new trans to out. So they pulled the bottom part of the engine out only and fixed it. well months later they had to pull the engine out again and this time rebuild all over again because they never fixed it right the 2nd time so the trans went out again. Now this has been going on for 2 years and the car is in the shop every month with something or other going wrong. Now that both the warranties have expired the trans is out again and we have a leak in the manifold and they won"t know if it's in the engine until we pay to have it pulled out again for the 4th time. Is there anaything we can do? We have all receipts for all the trips to the car shop and now it's going to cost more money . What do we do?

Re: white suburban problem
There are specific laws that pertain to warranties. If the auto shop fixed parts that were covered under warranty, and they are authorized to repair by the issuer of the warranty, the shop is required to repair the parts to their original working condition or replace them. Also, the parts that they are using should also be under warranty by the manufacturer so you may still have warranty protection. In any event, this shop is not adhereing to the law that pertains to warranties. You may have to file a lawsuit before your vehicle is fixed properly. You can make a claim for the mileage that you had to travel to have the vehicle fixed, lost wages, etc. I would need additional information regarding the specific warranties, what they "fixed" and what parts were replaced before I could tell you what to sue for ie. breach of contract, fraud, breach of warranty. I offer free, no obligation consultations. You can reach my office toll free at 877-546-9918, or by email at [email protected]. I hope I have helped shed some light on the matter. I wish you the best of luck if I don't hear from you.
