Legal Question in Civil Litigation in California
My wife recently went to an eye appointment for a checkup. When she arrived she gave the receptionist our insurance information and proceeded to wait to be seen. Later - about half way through her eye exam, the receptionist came in and told my wife that the office did not accept our insurance. My wife stopped the exam immediately and asked why wasn't she informed before the exam started as we would have gone elsewhere. She was told that it is her responsbility to find out whether or not the office accepted her insurance or not and it is not their problem. She was also told she was responsible for paying for services rendered regardless of the insurance issue. We have received calls from the office since then asking for birthdates and other personal information and asked for payment. No paperwork was ever signed accepting responsibility.
How should we handle this and are we responsible as we were not informed that the office did not accept our insurance until after the exam started? Do we have grounds to say we will not pay? We do not want her credit negatively impacted over this. Not sure if matters but we are also in CA.

You are responsible. If you sit in a barber's chair, and he cuts your hair, is he entitled to get paid, even if you didn't sign a written agreement?
