Legal Question in Civil Litigation in California
Where will this small claims action take place & how?
Personal property shipped to me by a common carrier arrived damaged. The carrier has not denied that they broke the item. The replacement or repair cost far exceeds the insured value of $1200.00. They paid me $100. I want to sue them in small claims court for the insured value. They do business throughout the U.S. Their agent for service of process is a corporation in southern California. I live at the other end of the state. Can I file in my county? Where will the case be heard?

Although the agent for service of process is in S. California, is the corporation out of state? If so, you can sue where the property was to be shipped -- i.e. in your county. You can have a friend serve the out of state corporation by certified mail, return receipt to the corporation's president.
