Legal Question in Civil Litigation in California
I work as a part-time caregiver for an elderly lady. The daughters, one is 60 the other 70 have decided they don't want me going to the bank for the mother. The sent over a lady from elder abuse to question this, the social worker said everything was o.k. Then today, another man called the lady asking quesitons about me and if I go to the bank for her. She said I am a good worker and go to the bank for her and alway give her the sealed envelope. Then the man asked what do you do with the money.
I called the sheriff and they said this is civil. But to be careful of the daughters because they are harassing. What else can I do to protect myself? Is it legal for someone to ask what you do with you own money?

It is legal to ask almost anything of a person, except to engage in a crime, but you normally do not have to answer if you do not want to. To protect yourself, the next time she goes to her physician, tell him/her what the situatiion is and can they write a short note stating that she has no mental defects and understands what you do for her, so that the daughters can not claim you are taking advantage of her. Also, get her to make a written declaration that she has not told you what her Will says and you have not used duress or undue influence to make her do certain things of an economic nature. Write the daughters and tell them they should put in writing what they feel you are doing wrong and have the mother and yourself respond in writing to theri complains. Have her also tell them to stop annoying you and her.
