Legal Question in Health Care Law in California

empoyer sharing personal health info with other employees.

My daughter (age 21) has a seizure disorder (hormonal) she confided the situation with her employer (a family restaurant). The manager she spoke to shared her personal information with other managers and employees without her consent. As a result rumours were spread and her seizure disorder became the topic of conversation and resulted in one of the employees saying she looked ''disoriented''. My daughter is entering her last semester in a University and is double majoring in English and Journalism, she is also in the honors program. I tell you this because her seizure disorder (it started 4 years ago) has never held her back and she is very private about it to avoid any stigmas. Her fears became realized when she did confide her disorder to the manager and in turn it was told to everyone. Is this legal? This manager told her that it is in the past (it happened in July 07) and it shouldn't be mentioned anymore even though it has directly effected her job and the treatment she has been given. After that worker said she was ''disoriented'' my daughter was demoted from server in training to a host. Is this legal? How does the Hipaa (sp?) law protect her?

Was the information shared with the other employees & managers to ensure your daughters safety in the event of a seizure? You mention that "rumors" are being spread, what type of rumors? You should consult an attorney to fully evaluate whether the demotion was a result of your daughter�s condition.
