Legal Question in Health Care Law in California

My Fiance has been a pharmacy tech for 7 years. Her and her ex had a daughter in 2007. Sometime in 2008 while still working as a pharmacy tech her ex urged and pleaded with her to attain some Paxil for his bi polar disorder and depression. She was very afraid for the safety and well being of their daughter, she believed he could be a threat to her well being in his state of mind. He didnt have insurance for himself so my fiance put in a false prescription and gave it to him. She has since lef the abbusive relationship, but he constantly threatens her, telling her he will report her and she will lose her job and daughter. What can we do?

She should have handled things much differently, I am sure she realizes now. Abusive guys like to threaten constantly, and this keeps her "hooked" into him from his perspective. He likely would get into trouble too, so I am not sure what he would gain out of reporting her. I also don't see what custody advantage he would have over her, since he was a willing participant and the one taking the meds. She can either take a constant flogging from him for the next 10 or more years (and then worry about him telling the daughter what an evil person she is for breaking the law), or she can take a stand and be willing to pay the consequences. Hopefully the daughter will not suffer because of this. What she did was wrong, whether she was abused or not. She could have taken her daughter and fled to a shelter if she felt she was in that much danger, not participate in an act that has the potential to have mom taken away and render her unable to protect her child. I understand being abused, been there myself, but sometimes you have to be willing to drop absolutely everything to escape. I did it, I know it isn't easy, especially when people think it is somehow your fault for being his victim. I would make no statements regarding anything before talking to an attorney regarding the forged signatures, because I am not certain what proof he has that implicates her in this matter.
