Legal Question in Health Care Law in California

Health and Safety Code Violation 1569.17 and 1569.58 et al

My husband has lost his job due to not having an exemption from his background check. His job is in a federally funded institution as a maintanence keeper. Several years ago and while married to his ex-wife he was sited for misdemener battery. While he was the one who called the authorities because his ex-wife broke his nose and left him and two small infants at home, non the less my husband was sited not her. He completed anger managment classes, but while he was still on probabtion, he was arrested for DUI. again having to complete another three year probation and another anger management course. This has all been over five years ago. What can I do to get the state to give my husband an exemption. He is a good man and very well liked by his employers, co-workers and residence at the facility. While he is not prould of what happened he has learned from his mistake and has tried very hard to overcome all of this and put it behind him. Do we have any legal argument? He has been employed at this facility for two and one half years without any problems, he is not a threat, and everyone loves my husband.

You may be able to set up a hearing if you act within a set timeperiod after receiving a denyal. Also need to deal with the criminal record, ie., expungement. We have handled numerous such hearings. Lost some and won many, despite lapse of time, etc., they are stringent.
