Legal Question in Health Care Law in California

Missed appointment fee legal?

A dentist wants to charge a missed appointment fee. Is that legal to do if I do not remember signing anything or seeing anything posted??? And if it is legal, what is considered normal? Is there any thing I can refer to in writing, like on the web? Thanks!

Re: Missed appointment fee legal?

It's legal. You made the appointment, at which time a contract was formed (implied from the fact that the appointment was made). The contract provided that the Dentist would be ready, willing and able to work on your teeth during the appointment time, and you agreed to pay.

If you didn't show up, that is lost time. The Dentist can't fill that vacancy at the last minute, so you must nevertheless pay for the appointment.

Most professionals who charge for missed appointments don't charge full rate, but it's an accepted practice to charge something.

The burden of proof is on the creditor to prove out any negative items they try to sue on or report to your credit bureaus. If they cannot prove it, you do not owe it, and that negative item must be promptly removed from your credit reports or you have remedies.
