Legal Question in Health Care Law in California
My mother may join a class action suit against a particular drug. A law firm has mailed her papers to sign stating their fees. They are taking 40% of her awarded settlement plus attorney's fees. Doesn't a judge determine the lawyer's percentage? Will she need to commit to those conditions before she gets started? Also, how does she find a legitimate firm with which to join this suit?

There's really no telling. They could drop her case at the last minute. Or she could get a letter saying she won the lawsuit and she gets something worthless like a coupon for more of the same drug. Or she could get money out of it. The fee percentage is not fixed by the court but is whatever she and the law firm mutually agree on.
