1-94 expired and extension of H4 visa

I have a situation where the i-94 and H4 visa expired in July 2003 and H4 was not extended by the employer's lawyer(partly due to miscommunication and other circumstances in personal life).

The principal's H1 is valid till 2005.

What is the fix for the situation? Is applying for H4 extension via i539 a feasiblity? What are the chances that the request for extension will be granted?

Is there a channel to appeal to the local elected officials to help me in the case with INS? Any feedback or suggestion would be very helpful?

We can file for late appeal on the basis that you discovered recently that the visa was not extended due to ineffective assistance of counsel
