can an illegal alien be petitioned as an alien relative ( i 130)?

Yes. an illegal alien can have a petition filed on his or her behalf by an immediate relative who is a U.S. Citizen or a Legal Permanent Resident ("green card" holder).

Ofcourse. If the beneficiary is not under 245 (i), needs to go back to home country for final adjustment interview and apply for waiver.
