Legal Question in Immigration Law in California

I came to the US when I was 5. I came legally with a visa but overstayed. I am getting married next year to a US citizen. How long is the process for me to get a green card? I have my high school diploma and my bachelors degree. Never been in trouble either. Please advice.

Since you were admitted to the US with a valid visa, you will qualify to adjust your immigration status through marriage. Since you fall into the immediate relative category, the lenght of time to process your petition will depend on the case load that your immigration center will be handling at the time of your application. Once you file your petition and get a receipt number, you can always check on the progress of your application through USCIS website.

Marriage based green card applications can take 4 to 6 months depending on the complexity of the case. Did you ever leave the country after you first entered when you were five years old? That may have an effect on your application. Please feel free to contact me at 415-273-9123 or [email protected] to discuss this matter further.
