You may file the I-751 with a waiver of the joint filing requirement if you have a divorce decree. If you do not have a divorce decree by the time of your I-751 interview, USCIS officers will generally continue the adjudication of your petition until the divorce is final. Please feel free to contact me to discuss this matter further.
