Legal Question in Immigration Law in California

abuse

I have been married for a year and want to get divorced because I have been mentaly abused. I have heard that that in this case I could stay in US legaly. Is that true? If yes what does it take to fight for staying here legaly?

yes...you heard that right. You need to document your abuse by going to mental health professional, etc.

You probably heard about the special immigrant classification. You must be able to prove that you are a battered spouse of a US citizen or resident. I suppose psychological abuse may qualify, but you need substantial amount of proof. In other words, mere nagging by your wife won't do it. Good luck.

As the other attorney said, you would need substantial psychological proof, maybe psychologist's reports and other witnesses.

BTW, I assume you're a woman who's being abused by your husband, and not simply a husband who's being nagged by his wife!
