adjustment of status for immigrants with unlawful presence status

Hi,

I am wondering about prez-gonzalez vs Ashcroft cas and ultimatly about Acosta law.

does this apply to undocumented immigrants who entered US and are married to a US citizen without visa?

The answer is maybe. Perez-Gonzalez and Acosta are cases dealing with those who re-entered illegally without inspection after having been deported or acquired unlawful presence of more than a year in the U.S. So, it depends on the situation.
