Legal Question in Immigration Law in California
adjustment of status permanent resident
My husband filed a petition for me an my 2 children on March/2000 he died on january/2004 and on august/2004 the petition was approved, I filed form I-485 with a form I-864(substitute)on 05/2007. I did the biometrics and on 08/2007 I went to the appoinment for adjustment of status the officer asked for my husband I explained to him, he was dead, that I have a substitute, he told me I will receive a decision on the mail, a month later I received a notice of denial and on 11/2007 a notice of hearing of removal-deportation for 01/2008 it's there anything I can do?, I have a visa V which expires on 01/2009, I'm confused, I came to the US with a visa V, I don't know if I was denied because my husband died, the letter says because I'm illegal, but I have a visa V,what can I do? it's hope for me and my children?

There's lots of options. But you need to go to the immigration court on that day. You need to retain an attorney.

You will need to appear before an Immigration Judge and may be able to apply for reinstatement of an I-130 petition based on humanitarian reasons.
