Annulment?Alien Residency?Green Card

I got an annulment based on fraud from my ex. He was abusive and stole my property (real and personal). When we got married he was in deportation proceedings. The only reason he was able to stay was because of the marriage. What can I do to get my property back and get him gone?

Dear Inquirer:

If you report the fraud to the USICE and provide them copies of the annulment judgment, they may place your ex back in removal proceedings and revoke his green card.

If you are pursuing the property he misappropriated in the family court, however, you may wish to resolve those issues before you take action to have him removed from the US.

The family law court has jurisdiction over the property issues, you should have asked for an award of the property there. You may still be able to get it post-judgment. The documents have to be reviewed.

If his only relief in removal (formerly deportation) proceedings was truly based upon your marriage, the annulment is fatal, and he'll be deported. But that is totally a separate issue over which you have no control, only an influence.
