Legal Question in Immigration Law in California

Trying to apply for a green card for husband

My husband and I have been married for 12 yrs and have 2 kids together. He has a jail record of misdomenor domestic abuse from about 11 yrs ago. We went to a lawyer for help and he ripped us off. We have not been living together for years because I am on Section 8 housing and they wont let him live here with us. We are still a couple though..How hard is a case like this one going to be?

Re: Trying to apply for a green card for husband

There are a couple of issues:

1. whether whoever is from abroad is likely to become a public charge; and

2. whether the domestic abuse charge will create obstacles in the process.

3. whether the relationship is bona fide, meaning a real relationship, even with the separation.

This is a complex situation that requires skill to navigate for you properly. Feel free to contact me if you are interested in hiring an attorney.
