Legal Question in Immigration Law in California

Applying for Citizenship and applying for green card for spouse

My Permanent residency start date: December 15, 2004.

Considering I lived in U.S. since then at the earliest when can I apply for citizenship. Also my wife currently holds an H1-B visa how soon can I apply for a green card for her?

It depends on how you received your permanent residency. Generally, you can apply 4 years and 9 months after receiving residency, assuming you meet the other requirements of having lived in the U.S.

I would wait until you have citizenship to apply for her change in status. It would be quicker.

You likely have a 5 year wait from when you received status, to when you can apply for citizenship. The process can take longer depending on where you are from, and your background check.
