Legal Question in Immigration Law in California

We have approved I-140 in March 2007 (process was one month long). Because of retrogression (EB3 RAW) we can't apply for Adjustment of status until now (PD 17. March 2007). My son will turn 21 in October this year (2011). Is he protected by "Child status protection act" or not. Does he need to change visa from H4 to F1?

When he cross the border he got H4 visa stamp until August 2013 (that is date of my H1B visa expiration).
