Legal Question in Immigration Law in California

my boyfriend was deported for 10 years, im a US citizen if we get married can he come back to the US even he hasn't completed his 10 years, we have a son together and I'd like him to come back to the U.S. so that he can have a better job and be together is that possible?

Possibly. One strategy is to see if he was removed because of the commission of a crime. If he was not properly advised of the immigration consequences of a guilty plea, then the verdict may be set aside. Another strategy is obtaining a hardship-based waiver. Call our office, (805) 549-7745.

The fact that you have a son together is an important factor in obtaining the waiver that Andrew speaks of. I should add that obtaining hardship waivers from US consulates abroad for a 10-year re-entry bar is extremely difficult. On the other hand, if your child is a US citizen and is facing hardship as a result of being far from his/her father, a psychologist's report stating the full emotional/educational and social struggles facing your child as a result of being away from his/her dad, may allow a possible opening into the case.
