Legal Question in Immigration Law in California

My boyfriend came here from legally on a work and student visa about 9 years ago. He over stayed his time and did not renew his visa. What are our options? If we were to get married, would he be deported to go through a process or would he be allowed to stay in the US during the process because he came here legally?
