Legal Question in Immigration Law in California
Bring my wife on I-130 or other way?
Hello, I'm a US permanent resident with a green card. Got it on March 2006 on asylum basis. One month ago I was in my home country and got married there. I'm trying to figure out the best way to bring my wife here sooner rather than later. What would be the fastest route to take? Should I apply for I-130 and wait years or try bringing her on a tourist visa, then file I-130, and have her come and go until I-130 is approved? How likely is she to get denied or approved tourist visa? Please advise.

The family 2A (spouses of lawful permanent residents) category is currently processing applications received November 15, 2002.
You'll likely want to apply for the I-130 as soon as possible although doing so will signal immigrant intent and make it more difficult for her to enter the country as a B1/B2 visitor.

I will not recommend I-130, it will take time moreover...you should not have gone back to your home country to get married...INS can revoke your asylee status. You can try to bring her as tourist...if she has degree...you can bring her on H1B.
